With this data protection notice, we, PKE Gebäudetechnik GmbH, FN 488210g, Computerstraße 6, 1100 Vienna, explain which and how your personal data is processed. We operate the website www.pke-iot.expert, the IoT Plattform cloud.pke-iot.expert and both Android and iOS apps PKE IoT Expert Mobile (Link to Play Store, Link to App Store).

We process the following of your personal data for the fulfillment of contracts with you or for the implementation of pre-contractual measures, as well as for information and marketing purposes, which are carried out at your request (Art. 6 para. 1 lit. b GDPR) if you provide us with this data or on the basis of a legitimate interest (Art. 6 para. 1 lit. f GDPR):

  • Contact person

  • Contract data (e.g. subject matter of contract, deadlines)
  • Other personal data transmitted for application purposes

2. DATA PROCESSING PURPOSES

Your personal data listed under point 1 “Processed category of personal data and legal bases” will be processed for the following purposes.

  • Processing of inquiries in connection with our activities
  • Provision of contractual and pre-contractual services
  • Organization and implementation of events in connection with our activities
  • Acceptance and evaluation of applications
  • Optimization of our services and marketing
  • Administration and organization of the company You provide some of your personal data voluntarily. However, we can only process your requests if you provide the personal data required for the respective purpose.

3. TRANSMISSION OF PERSONAL DATA

We will transfer your personal data to the following recipients for the purposes stated in point 2:

  • Data will be processed within the company and transmitted to parent, subsidiary and sister companies

Some of the recipients of your personal data listed above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection. Alternatively, data is transferred to third countries (if there is no appropriate decision by the Commission pursuant to Art. 45 GDPR) on the basis of suitable guarantees pursuant to Art. 46 GDPR or on the basis of consent for specific purposes.

4. USE OF COOKIES

We use cookies on our website. A cookie is a file that can be stored on your device when you visit a website. They are generally used to offer certain functions (e.g. improved navigation or storage of settings). Cookies do not access or process any other data.

4.1. SERVICES FROM GOOGLE

We use Google Maps and Google Fonts on this website. Google Maps is a map service and Google Fonts is a directory of fonts. Both services are provided by Google Inc (Google), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Neither service places any cookies in the technical sense on the user’s device. Nevertheless, personal data such as the IP address is transmitted to Google. Your data is processed on the basis of our overriding legitimate interest (Art. 6 para. 1 lit. f GDPR) in providing navigation and improving the usability of the website. The personal data is transferred to and stored on Google servers. These are located in the USA or other countries outside the European Union. We ourselves do not store any of your personal data in connection with these services.

Data such as the following is collected:

IP address, browser, type and model of end device, service provider, screen resolution, length of visit, language, operating system, subpages visited. The information obtained is used to analyze usage and compile reports on activities on the website.

Data is transferred to third countries on the basis of suitable guarantees in accordance with Art. 46 GDPR or on the basis of consent for specific purposes if there is no appropriate decision by the Commission in accordance with Art. 45 GDPR.

We use settings from Google that anonymize the IP address. The IP address transmitted by your browser will not be merged with other data by Google.

5. STORAGE PERIOD

We will only store your personal data for as long as we reasonably deem necessary to achieve the purposes set out in point 2 and in accordance with applicable law. The personal data will be stored at least for statutory retention obligations or as long as the limitation periods for any legal claims are open.

6. DATA SECURITY

Your personal data is protected by taking appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, unlawful or accidental access, processing, loss, use and manipulation. Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons. Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking attack on email account or telephone, interception of faxes).

7. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

You have the following rights regarding your personal data in accordance with the applicable legal situation:

  • Right of access: you have the right to obtain from us confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and further information and a copy of the personal data.
  • You have the right to request the correction, completion and deletion of your personal data if they are incorrect or incomplete or are not processed in accordance with the law.
  • You have the right to demand that we restrict the processing of your personal data.
  • You have the right to data portability, i.e. to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit those data to another controller to whom the personal data have been provided.
  • Under certain circumstances, you may object to the processing of your personal data and withdraw your consent to the processing of personal data. The revocation does not affect the legality of the processing carried out on the basis of the consent until the revocation.
  • You have the right to lodge a complaint with the Austrian Data Protection Authority.
